Can my brother (Siblings) sponsor me to Australian PR - Aptech Visa

If your brother has an Australia PR, he may sponsor you. Applying for the 491 visa, also known as the skilled work regional (provisional) visa subclass 491, is what you can accomplish. Australia Skilled Regional Work Visa 491

To live and work in remote Australia, skilled individuals must be sponsored by an eligible relative or nominated by a state or territory government. For the duration of the visa's five-year validity, you are permitted to make as many trips to and from Australia as you like. After three years have passed after you received your 491 visas, you may submit an application for Australia PR (subclass 191 visa).

Australia 491 visa application process

Your first step in expressing interest in applying for this visa is to submit an Expression of Interest (EOI) through Skill Select. Kill Select does not charge fees to create or submit EOIs since they are not visa applications. The assertions in your EOI will be used by Skill Select to determine your point total. To be eligible to apply for a visa, you must receive at least 65 points.

If you have said that you are interested in being nominated, state and territory government organizations will be able to see your EOI. You'll receive a request to submit an application for this visa if they recommend you.

You must submit the required documentation to prove your identification, skills assessment, level of English proficiency, relationship, partner, sponsor, and character claims made in your EOI and to demonstrate that you meet all visa requirements.

The invitation will thereafter be valid for 60 days after the date of the invitation, after which the invitation will expire.

In order to support their spouse or common-law partner:
  • It is a requirement that you be at least 18 years old.

  • During that time, you must pay back any provincial social assistance that your family members received.
  • The sponsorship agreement, which outlines the duties you and your sponsored spouse must agree to during their undertaking term, is also required.

According to this sponsorship agreement, you will:
  • Provide for the basic necessities of your sponsored partner or spouse;
  • As part of the application process, you will fill out and sign a form that includes a sponsorship and undertaking agreement.

The following steps can help you sponsor your spouse to Canada:

  • Pay your application fees, which comprise a $75 sponsorship fee, a $475 processing fee for the principal applicant, $490 for the right of permanent residence, and a $25 biometrics fee.
  • Send your application and the necessary paperwork via ordinary mail or courier service.

How can I demonstrate to the IRCC my relationship with my spouse or partner?

Your spouse or partner must be sponsored for Canadian immigration by you in order to do so, and IRCC needs to verify that the relationship is real.

You may sponsor a foreign national to move in with you in Canada and become a permanent resident if you are a Canadian citizen or permanent resident in a relationship with that individual. Your spouse, common-law partner, or romantic companion may be sponsored.

You must be able to show that your relationship with the sponsored individual is truthful by offering proof and accompanying paperwork in order to qualify for spousal or common-law partner sponsorship. Whether you have a spouse or partner will affect the criteria for demonstrating your relationship.

Demonstrating your marriage to your partner

A list of documents that can be used to prove your relationship with your spouse is provided by Immigration, Refugees and Citizenship Canada (IRCC), including:

  • A completed IMM 5532 "Relationship Information and Sponsorship Evaluation" questionnaire.
  • A marriage license and evidence that the union was officially registered with a government body.
  • If your partner was previously married, evidence of the divorce.
  • Long-form birth certificates or adoption records that list both parents' names if you share children.
  • Pictures and invitations to weddings.

  • Proof of shared bank accounts, credit cards, or utility accounts (such as electricity, gas, telephone, and internet).
  • Evidence from the couple's auto insurance that they both listed the same address as their primary residence with the insurance provider.
  • Documents issued by the government bearing the same address (such as a driver's license);
  • Additional records demonstrating the couple's shared address (such as phone bills, pay stubs, tax records, etc.)

Demonstrating your partnership with your partner

Additionally, the IRCC provides a list of documents that can be used as proof of your relationship with your spouse, among them:

  • A completed IMM 5532 "Relationship Information and Sponsorship Evaluation" questionnaire.
  • Proof of divorce from a prior spouse, if either party was previously wed.
  • A completed IMM 5519 form if one of the partners has ever been in a common-law union with another person.
  • If the couple has children in common, long-form birth certificates containing the names of both parents are required. A couple’s photos are also needed.

Couples must additionally submit two sets of documentation from each of the following categories (or a written justification if you are unable to submit evidence from two or more of these categories):

  • Records attesting to the couple's status as common-law partners (such as employment or insurance benefits).
  • Evidence that the relationship is acknowledged by friends and/or family and that the couple shares expenses or provides financial assistance for one another (letters, social media information showing the relationship is public).

How to sponsor your Indian spouse to Canada?

If your spouse or common-law partner lives in India, follow these steps to become a sponsor.

Are you looking for information on how to sponsor your Indian spouse for Canadian immigration?

Canadian citizens and permanent residents can sponsor their foreign spouses, common-law partners, dependent children, and conjugal partners through Immigration, Refugees and Citizenship Canada (IRCC).

You can sponsor someone from India for permanent residency (PR) in Canada if you are a Canadian citizen or permanent resident who is married to them or has lived with them for one year as common-law partners.

Obtaining permanent residency in Canada will allow your Indian spouse to live and work in Canada, as well as access to health care and social assistance.

In order to be eligible for family sponsorship in Canada, both of you must fulfil a number of crucial standards.

First and foremost, you must consider the age restriction for sponsors, who must be at least 18 years old.

Spousal sponsorship has no financial requirements, but you must demonstrate that you have a strategy to financially support your family, including yourself and the sponsored individual. You can do so by demonstrating that you have enough income, savings, or assets to support your entire family. Furthermore, unless it is due to a handicap, those receiving social assistance are not eligible for sponsorship.

On the other side, your Indian spouse or partner will be investigated for probable inadmissibility and criminal convictions.

Providing the needed documentation to verify that your relationship with the sponsored individual is real is one of the most crucial elements in the process of sponsoring a spouse to come to Canada. If you are married, you will be required to present certain papers, including a marriage certificate, among others. Legally executed marriages in India are typically lawful in Canada. In place of a marriage certificate, you must produce documented, documentation of your 12 month cohabitation term if you are in a common-law partnership.

Although most documents produced in India are in English, you will need to offer a translation if you have older documents that were issued in Hindi or another language. These translations must be validated and fulfil IRCC specifications.

If the documents supplied are insufficient proof of a genuine connection, or if an officer wishes to examine updated documentation regarding cohabitation or the continuation of your relationship while living apart, they may request more information or schedule an interview with you.

Keep in mind that the officer reviewing your application has discretionary authority, and cases are examined on an individual basis. As a result, it's critical that you submit a strong sponsorship package with as much supporting documentation as possible.

The Canadian Sponsorship Process: What You Need to Know

You must apply to the Immigration and Refugee Control Commission (IRCC) at the federal level.

For permanent resident (PR) status, you must submit two separate application components: your sponsorship section and your spouse's or partner's portion. The two components must be submitted jointly to IRCC.

You'll also have to pay IRCC a charge for applying for family sponsorship.

You must ensure that your application is sent to the proper address. This information may be found in the government's sponsorship handbook, which you can download.

You can stay in India if you are a Canadian citizen, but you must show that you intend to travel to Canada with your husband after he or she secures a permanent residence visa. However, if you are a permanent resident of Canada, you must live in Canada to sponsor your spouse or partner.

The time it takes IRCC to process a sponsorship application is usually around 12 months.
