HOW DO I QUALIFY FOR PERMANENT RESIDENT STATUS IN CANADA? – APTECH VISA

Immigrants must enter Canada once before their Confirmation of PR expires and stay for at least 730 days within the first five years after landing. As a result, many permanent residents put off moving to Canada until they are financially secure enough to live in the nation for the first few months while looking for work.

The start and end dates of the five years are determined by the exact date of landing. This '5-year period' will be defined as the first five years after landing in Canada if you received a Canada PR Visa and arrived in Canada less than five years ago. If you arrived in Canada more than five years ago, the 'five-year period' will be the five years prior to the residency obligation examination date.

In three instances, the authorities will examine if you meet the residency requirement:

Your PR card needs to be renewed or replaced when it expires

When you apply for a PR travel document at a Canadian visa office in another country

When you apply for permanent resident entrance to Canada at a port of entry

Even if you already hold a PR card, you must retain your PR status by meeting the residency requirement. Similarly, even if you do not have a valid PR Card, you can meet the residency requirement. For example, if you lived in Canada full-time and did not renew your PR Card when it expired, your PR status might still be beneficial. It is not required for all Permanent Resident Visa holders in Canada to have a valid PR Card with them at all times.

You have the right to enter Canada, regardless of whether you have a PR Card or have broken the residence requirement - as long as you have PR status. International travelers, on the other hand, will need a PR Card to return to Canada, as it functions as an admission document. You must return to Canada before your PR Card expires if you are in violation of the 730-day residence requirement.

Before taking enforcement action, you might request favorable consideration on compassionate and humanitarian grounds (along with supporting papers). If the review is negative, you can file an appeal with the Immigration Appeal Division and remain in Canada while your case is being resolved. If the review is favorable, the border officer will allow you to enter Canada and continue to meet the residency requirements.

After that, if you've met the residency requirement, you'll be able to travel outside of Canada and renew your PR Card. Consult our professional advisers digitally or visit our pan-India offices to learn more about the application procedure and compliance requirements for Canada PR holders.
