Australia says yes to same sex marriage In 2018, Australia will witness the first same-sex marriage, which will also mark the start of the same-sex spousal applications to be lodged to the Department of Immigration and Border Protection.
The married same-sex couples will be eligible for spouse visas. Earlier, they had to claim de-facto partnership status and had to submit the extensive evidence showing they were in long term relationship.
The new marriage equality law has given easier access of visa options to the loving and committed couples.
This means that according to the legal acceptance of same-sex marriage, you can apply for a visa as your partner’s spouse rather than a de-facto partner.
These changes are applied to Partner visas (Subclass 100, 309, 801, and 820). You can also apply for the subclass 300 (prospective marriage visa) on the basis of same-sex relationship provided you show a genuine intention to marry your eligible partner in Australia.
For the same-sex couples, proving a de-facto relationship was a stressful process. Earlier when there was no legal acceptance of their status, they claimed they were put at a significant disadvantage because they had to show more extensive proofs.
The marriage certificate can now prove the commitment of the same-sex partners and this move will therefore encourage more applicants to apply. The overseas marriages will also be recognized under Australian migration law provided they are recognized in their home country.
